The U.S. Bureau of Economic Analysis (BEA) conducts the Form BE-10 survey every five years to collect information on various U.S. investments abroad. The most current survey is due May 30, 2025, for anyone who meets the reporting requirements for 2024 (except those who are required to file more than 50 forms; for those filers, the due date is June 30, 2025).
The BE-10 survey is filed electronically via the BEA’s e-filing system and needs to be completed by:
- Anyone who is contacted by the BEA about reporting in the survey, whether they have a filing requirement or not.
- Any U.S. person who had direct or indirect ownership or control of at least 10% of the voting stock of an incorporated foreign business enterprise or an equivalent interest in an unincorporated foreign business enterprise as of December 31, 2024.
- A “foreign business enterprise” includes any organization, association, branch or venture which exists for profit-making purposes, as well as ownership of real estate held for profit-making purposes (foreign rental property).
- A “U.S. Person” means any individual, branch, partnership, associated group, association, estate, trust, corporation or other organization that is resident in or subject to the jurisdiction of the United States.
Because the BE-10 is only required once every five years, it is often overlooked. While there are no payments due with the survey filing, failure to complete this survey can result in substantial civil and/or criminal penalties. Extensions may be requested but are not granted automatically.
